No. 1552A Portugal Cove Road – Residential Subdivision Application
The Town of Portugal Cove-St. Philip’s is in receipt of an application to construct a residential subdivision consisting of twenty-two single dwellings on a new street connecting Newbury Street and Portugal Cove Road and a temporary cul-de-sac. The proposed development has been identified in yellow on the mapping below.
The area is zoned Residential Small Lot (RSL). The proposed development is currently under review in accordance with the Town’s Municipal Plan and Development Regulations 2014-2024 and the Town’s Subdivision Design and Construction Standards.
As part of the review process, Council is seeking input from the public. Council will consider all submissions received prior to making a decision on the application.
SUBDIVISION DESIGN

The proposed development will be fully serviced with curb, gutter, and sidewalk, and municipal water, sanitary sewer, and storm sewer. The development will also include above ground stormwater management infrastructure to satisfy the zero-net run-off requirements of the Town’s Municipal Plan and Development Regulations 2014-2024 and Stormwater Management Policy. Stormwater management infrastructure must be designed by a professional engineer and constructed to address both water quality (i.e. contaminants, pollutants) and water quantity control (i.e. zero net run-off) impacts of development. All costs associated with road development and the installation of off-site and on-site infrastructure required to support the development are borne solely by the developer.
The proposed building lots shall meet with or exceed the Town’s minimum requirements for single dwellings within the RSL zone with minimum frontages of 12 metres (39.4 feet) and minimum lot areas of 360 square metres (3,875.0 square feet).
PUBLIC OPEN SPACE
Public Open Space equal to 10% of the gross area of land to be developed is required to be dedicated to the Town (at no cost to the Town) in accordance with the Town’s Municipal Plan and Development Regulations 2014-2024.
The applicant is proposing conveyance of the following lands and construction of a granular walking trail from the proposed new street to the Towns existing recreation area on Newbury Street to satisfy the requirement for public open space as per Plan Policy SD-7 and Development Regulation 88(1):
- Land between No. 20 Newbury Street and the Towns existing recreation area, and the proposed stormwater management area;
- Land between the proposed connection with Portugal Cove Road and No. 1534 Portugal Cove Road, and;
- Land between the proposed temporary cul-de-sac and Ayres Lane.
The areas proposed to be conveyed to the Town as public open space are identified in green on the mapping below.
The requirement for Public Open Space is determined by Council, at their discretion, in consultation with the Town’s Community Services Department. If it is determined by the Town that land is not required in the area, Council may accept the payment of a sum of money equal to the value of the land which would otherwise be required to be dedicated.
PRIVACY FOR ADJACENT RESIDENTS
The Town’s Development Regulations 2014-2024 requires all new residential subdivisions that abut the rear or side boundaries of an existing residential lot(s) to provide a natural vegetation buffer or other structural barrier (such as a privacy fence) which shall be maintained by the owner or occupier to the satisfaction of Council.
If an applicant proposes to use a structural barrier within a new subdivision, the design of the barrier will need to be approved by the Town prior to construction.
REVIEW AND APPROVAL PROCESS

Once approval in principle has been granted by Council for a residential subdivision, the applicant will begin completing the detailed engineering design of the subdivision. The engineering design of the subdivision must be completed by a firm, and member, in good standing with the Professional Engineers and Geoscientists Newfoundland and Labrador (PEGNL). Once received by the Town, the engineering design is reviewed by the Town’s engineering consultant and Town staff.
In addition to the engineering design of the subdivision, other planning and engineering related matters must be addressed by the applicant and accepted by the Town prior to the issuance of a Development Permit; for example (in no particular order):
- Approvals from all required federal and provincial government departments and agencies;
- Submission of required securities to be deposited with the Town;
- Proof of required insurances;
- Payment of required fees, and;
- Signing of a Residential Subdivision Agreement.
Clearing of vegetation outside of the immediate area for which a permit has been issued by the Town is not permitted.
PUBLIC CONSULTATION
Council is currently seeking input regarding the proposed residential subdivision from the public. Council encourages all residents to view and comment on the proposal. Submissions to the Town must be made in writing and received by September 9, 2026.
